Interesting, and clearly very beneficial to have evolved convergently so many times. If I remember correctly, most of the fish that are able to do this are from freshwater, shallow environments where there is the possibility of stagnant water with low O2 content, so I guess that tracks?

Primitive lungs evolved in bony fish first, and some fish can still use them today. If you've ever seen a beta fish swim to the surface and stick it's mouth out, it's gulping down some air.

Why would anyone bother negotiating before it makes its way through the courts? You might end up spending time and energy on a deal were you might even give concessions, only for it all to be struck down by the supreme court anyway. The negotiating team was fucked before, but it's X2 fucked now.
