I agree with you. ACB also wrote a concurring opinion in immunity case that narrowed scope of official immunity so that official acts can be used as the motive in private corruption trial - such as when Saudis bribe him to send them tariff free chips. It would be helpful for SCOTUS to revisit this.

In practice, because there is no insurrection in LA, it means anyone hurt can bring a Bivens action to be compensated monetarily by executive officers
