Since 1980, there have been 29 ECtHR cases on deportation or extradition from UK. In 16, ECtHR found that removal would not breach the ECHR. In 13 cases, the Court found deportation or extradition would violate the ECHR. So the ECtHR prevented removal of just one foreign national every 4.5 years.

"European Court of Human Rights has seldom ruled against UK in relation to the removal of people from the UK. Indeed, it rarely rules against UK at all. It issued only one final judgment finding a violation of ECHR in a UK case in 2023 and one in 2024. Neither concerned immigration or deportation".

EU failure to comply with these obligations would engage international responsibility of the EU, which would be obligated to cease its unlawful conduct, and to provide full reparation for any such violations. This could be invoked in courts of the Member States or before the CJEU.

EU and members must adopt measures to prevent investment relations by EU-based companies and other entities that might assist in maintaining Israel’s presence in OPT. They are obliged to restrict or end dealings with companies on the UN database of enterprises benefitting Israeli settlements.

Expert Legal Opinion: EU must reassess its policies on products from Israeli settlements in order to abide by these obligations. This likely requires further restrictions, potentially outright ban, on any trade or economic dealings with Israel that would entrench its unlawful presence in the OPT.
