Agreed on all points. I suppose I’m asking the larger question here, that will likely only be determined by events. But the center can’t hold at this pace and things are going to get very frisky. CA really doesn’t like this president.

Our current problem is that courts both take too long and have been complicit in generating these problems. SCOTUS in particular. I get it, we’re a nation of laws, but slavery was law and Jim Crow was law, where, in light of this hypocritical court do we redress grievance?

Generally, the law, constitution and any interstate relationship is governed by norms and customs that define such a relationship. I would be interested to know if the nat gd has ever been called against the wishes of a state governor. Arguably, we are in new territory here.

Indeed, but tear gas and rubber bullets against shirtless people running from men armed with guns and riot shields eventually create a picture that turn into a counter narrative. They’ll burn police cars, sure, but rows of m16s lined up against civilians creates its own image.

Not to mention, ICE is dependent on a lot of local cooperation, what happens if the governor shuts off water and power to their offices? What does a federal state conflict large scale look like? We may find out.

I have questions. What happens when, (not if), the governor refuses to permit the guard to deploy? Does Homan send in the TX guard? How would that work? Already he’s activating the marines, doesn’t that violate the posse comitatus? What happens then?

Not yet, and that might be the where the rubber meets the road. Although he might want to push for a Kent state moment, he might face a lot of institutional backlash. The gov won’t cooperate, so what does the local guard do? Does 47 send in TX? The reg army? All are bad outcomes, but here we are.

Notable that the governor controls the national guard in their state. So if the president activates the guard he’s going to have to activate the guard from another state or else the actual regular army. Either one is t a good look. It’s going to be very hot and dangerous in LA this summer.

Not that I or anyone else have seen. Which is kinda the point. You present a badge when making an arrest. That determines accountability for the officer and their supervision. That’s how this works.

Because police have to be instructed to pursue an arrest. They have to have warrants, they have to present a justification for their actions. At best they can exercise crowd control. Notice how there’s few police there, how they aren’t assisting apprehension? That is a best outcome.
