It specifically allows it. The thirteen amendment contains an explicit exception to the ban on slavery.

At that point, if you wanted to completely remove it, you'd have to pass a national constitutional Amendment that supercedes or amends the Thirteenth amendment, removing that exception.

Maybe? There's not really any higher law of the land than the Constitution. A lawyer could reasonably challenge a state law banning prison slavery by citing the constitution, which explicitly allows it. It's not moral or right, but it's a valid legal argument.

Oh it was already legal. This is just the California voter base resoundingly approving of it. Happened in Colorado too.
