China owns the Byte Dance, and the court then held that Congress used the means necessary to stop the behavior pretty much— and it did not violate any individual’s first Amendment rights by doing so. I just assumed they used the rational basis test, but it was intermediate scrutiny test .

I gave you the incorrect standard. Supreme Ct did address the Free Speech issue but said the legislation was content-neutral - not regulating the content of the speech on Byte Dance. So the ct gave it intermediate scrutiny. It’s stated purpose was the spying by CCP because China is an adversary .

Trump is trying to show CCP that he has the power. And the Senate and Congress have their authority at stake. US has separation of powers to ensure that all the power is not concentrated within one branch of government or one person. This way there is a check and balance on Trump’s power.
