We're deep in a constitutional crisis, and at this point, we should be demanding that our state and local governments refuse to cooperate and treat ICE as a criminal enterprise.

US Martials are a Federal agency, not a state one. Even though they have martials appointed to individual states, they report to their office in D.C. which reports to (drum roll) DoJ. They are explicitly an enforcement arm of the DoJ. So you still want DoJ to arrest DoJ. That's why this is bad.

Now, technically, courts can deputize persons they deem necessary for enforcing the decisions of the court. But at this point, you are asking judges to essentially form a militia unit to get into an armed confrontation with the DoJ. There is no non-Civil War version of this.

And look, we might get there. But it honestly only works with the full support of the States or if there is ongoing civil unrest at the level where Fed is already fully tied up. I keep reading these stories. So many of them. Almost all of them mention, that friends and relatives that talked to these forcefully disappeared men shortly before March of 15th said that these men were told by ICE they are being sent to Venezuela. Aaron, Is it legal to lie them like that?
