NEWS: WSJ is reporting that Biden is considering death row commutations for “most, if not all,” of the 40 men on federal death row — and that Garland has recommended the “most.” WSJ says those who could be excluded, if any are, likely would be Tsarnaev, Roof, and Bowers. www.wsj.com/us-news/law/...

I don't think so, since the Post earlier had a story on him considering it. If anything, given where it's at, I'd go the opposite with this one — that someone opposed is trying to amp up opposition in the WSJ. But, I don't even really think it's that. I think it's just reporting.

The clemency would only apply to the death penalty itself, right? These inmates wouldn’t be released? I’m less familiar with commutations that simply reduce a capital crime vs free the prisoner.

He should commute them all. For more than one reason. Principle says no Death Penalty. 8th Amend says the DP is cruel in the extreme. Desert says let the worst of these folks live with themselves knowing who they are.

I wasn’t aware Biden could simply downgrade capital crimes to life in prison. I thought commuting those crimes would vacate the entire sentences. It will still give the republicans ammo, but less bad than I thought.
