IIRC the distinction between 2 and 3 is aimed at Barrett, who has written about the difference between “holding unlawful and setting aside” administrative action versus enjoining it. (I think this was her proposal on splitting the baby re universal injunctions?)

I mean, virtually all complaints challenging agency actions that have an effect on a private entity or person are going to seek both, so I don’t think that really has anything to do with Barrett.

In effect definitely. It just struck me as odd as having that language as an item of relief independent of any declaration or injunction. I think the usual view is that the APA “setting aside” is grounds for relief (injunction/declaration) but not relief in itself.
Maybe I’m wrong though
