I guess the country is fortunate that these Very Bright Lads finally came along to finally fix everything that was wrong with Constitutional jurisprudence over the last 236 or so years.
This appears to be what prompted the DOJ announcement from Mizelle, although the DOJ release did not include any link to this letter sent to Grassley today. (Also unclear is if they sent it to Durbin, the Dem ranking member, as well.) Mizelle posted it on X tonight.
I thought SCOTUS determined what laws are constitutional. And DOJ was supposed to enforce the laws until they are ruled unconstitutional

Essentially, consumers/companies are required in some situations to file a dispute with a federal agency, which is heard by an administrative law judge, before filing a lawsuit in federal district court, which can be appealed up to SCOTUS.
[1] Ultimately SCOTUS does decide what is and what is not constitutional. DOJs memo doesn't change that. DOJs memo suggests they are going to fire independent mind ALJs and replace them with loyalists.
