@mrose.ink continues to make the fair point that this could have been (un)friendly fire from the rightsholders but I think the report was an unequivocal loss for the AI companies on just about every issue that mattered
I think that’s overstating it pretty significantly. It was only a major loss if they were expecting categorical endorsements, and if they were, well, they need better counsel
I’ll give it another read with a less jaundiced eye but my initial reaction is that it rejected almost all the key arguments re: prima facie infringement and fair use that the AI companies need to break their way
Also if the rightsholders really went for the Register over *that* report *after* the WH went for the Librarian on anti-DEI grounds, they are the biggest gamblers on the face of the planet
I also would guess that the WH was happy to lean into the virulent anti-DEI angle to fire the Librarian but it’s hard to see how that fits firing the Register
