Judge Howell spent a lot of time at the hearing questioning counsel about the peculiarities of USIP's status as a non-profit created by statute -- is it like a federal agency or not?-- but spent ZERO time asking comparable questions about DOGE.

DOGE wasn't the focus and is part of the executive. The problem is USIP functions at worst like an advisory committee of Congress. Those aren't executive branch bodies.
Yes and it's board must be approved by the senate and I believe the board picks the chairperson. But in an argument between Trump and USIP doges formation is inconsequential.
Because the issue isn't DOGE's power, the issue is whether or not Trump has the authority to remove the board members. DOGE is a moot point if the Trump-appointed USIP president is actually in charge.
I think USIP can win on the merits but apparently the lawyer needs to get their ducks in a row.
I’m just being crazy here but everything seems so fucking rigged. A couple wins yesterday for one side, a couple today for the other side. Yet no real action anywhere and they continue to break the law.
We're going to see an avalanche of decisions based upon excruciatingly small technicalities, thus giving them an out so they don't have to do anything. Then, the small number of judges who have stood up will realize it's no longer worth it to stick their necks out.
The Biographies of all the political figures of this time will ask the same question: when and how were they Totally Corrupted.
It's the only thing that makes them interesting.
