Have to disagree here. Speaking as a lawyer, we need less private enforcement action by lawyers. More state capacity. Adding a ton of private attorneys has completely screwed zoning and development makes things horribly inefficient.

Private enforcement on stuff like the environment is bad, but DOL are complete cucks when it comes to wage and hour matters and private enforcement of pay issues works amazingly.

If anything they have much greater resources and settlements in wage and hour matters generally at the FLSA level aren't based on a %. The issue is far more that private counsel put in a lot more hours.

Again, my point is more: if you want to go after employment law scams, make that a priority and hire the lawyers. I don’t think private enforcement, outsourcing state capacity, is ever the right answer. Whatever the issue: make it a priority and do it yourself.

My point was more general. Empowering the plaintiffs bar is essentially outsourcing more state capacity/enforcement action. You want to hire 1000 lawyers in 2028 to go after white collar crime at DOJ? Totally in. But we need state capacity not more private lawsuits.

This is true. But I don’t think it’s good and I certainly don’t want more of it. Any port in a storm, for now. But long term we need government capacity, even if at the state level, to deal with issues. Private lawyers are not generally going to be a satisfactory solution.

There’s no question that outsourcing almost all enforcement to plaintiffs was a huge design flaw. If I could do it again, I’d remove the profit motive from anti discrimination enforcement but that’s me
