Which judge are you inquiring about? The SDNY district judge on the Adams case is a Biden appointee (and wasn’t a smooth confirmation even considering Republican baseline obstruction). There is Trump appointee in the 5th circuit appeals court with same last name.

Because it's widely believed these charges can and should be handed off the the NYS AG or Manhattan DA. Conveniently both of them were "sued" by Bondi yesterday, thereby giving the impression that if/when they bring charges they'll somehow be tainted.
