LegalEagle had a good breakdown of this. Refusal is legal but highly unlikely, but the much more viable option is to require them to dismiss with prejudice so they cannot use re-filing as an enforceable threat to extort compliance. Literal mobster shit.

Does the ability of the State to file charges depend on whether they are dismissed with or w/o prejudice?
Can the State get the evidence from the DOJ or do they have to do their own detective work and get witnesses under oath?
