I really don't understand the Justice's reasoning. Unless their contention is that it's the executive that controls budget allotment and not Congress, their argument falls flat, especially since line item veto has been ruled unconstitutional.

There is no logic. It is stunning that Justice Alito thinks it makes sense to withhold $250 million for work already completed while the court decides if the sovereign immunity claim raised by the Trump administration ends standing for the plaintiff.

I can't say that I'm overly familiar with the Tucker Act, but it certainly seems that immunity waiver would apply for work that has been completed or was in the process of being implemented or applied.
