Indeed, in British licensing laws the customer can request a top-up if the head is deemed "unreasonable", although what's reasonable may vary; a reasonable head on a pint of Guiness, for instance, may be unreasonable on a lager.

Side note: shot glasses are exactly 1 shot to the very brim. You can free pour, spill a bit and if it's a couple of mm from the brim on a line of shots the customer is happy, you looked fancy and you've got a sneaky free shot for yourself or the books.
