Just to clarify, this is called a Notice to Appear, not a motion to appear. It’s the charging document required to present grounds for detaining an immigrant. And nearly all immigrants who become detained don’t even know why until they receive it. (I’m an immigration attorney)

We were already aware of this specific argument from the Secretary of State as its rationale for why Khalil should be deported. But this document was likely the first time Khalil learned of the justification, shortly after his arrest.

Remember what Snyder says in Chapter 17 of On Tyranny. He quotes a Nazi writing that basically says that the way to destroy rules is to “focus on the idea of the exception.” Therefore, it’s energizing to see that the protesters are not seeing what happened to Khalil as an exception.
