To be clear, the judge said in the hearing today that his TRO was NOT anticipatory and did not block reliance on AEA as basis for removal, because at the time he ruled on the TRO he thought the AEA had not yet gone into effect. So the appeal is not likely to resolve this issue either.

Monday's hearing has no clear agenda, but I guess he may entertain arguments about modifying the TRO.

The federal courts do not shut down due to a lapse of funding. They have a budget to draw from plus collect user fees. That said, after 30 days those funds start to get thin. So, Schumer part right, but part wrong. Obviously, a gamble either way.
