Yes. #WongKimArk was argued by J. Hubley Ashton—my great-grandfather—before SCOTUS in 1898. Fun fact: the Solicitor General of the day was a former Confederate Major who had been allowed back into government. I don't know how widespread the practice of flying as a tourist and giving birth in the US is. But I suspect it is very low compared with unauthorized migration at the border. As an immigrant I don't give a shit. But there's plenty that do even when they themselves are now citizens.... Go figure

I don’t know how SCOTUS will square the circle of declaring immigrants not to be under the jurisdiction of the US yet still being subject to its laws and judicial system, but I’m sure they’ll apply some tortured reasoning to make it happen

I was thinking that since it’s not defined in statute that it would be possible for republicans in congress to get cute and make a definition that gives some sort of avenue for them to get what they want.

Congress is probably too dysfunctional to do it though.

American Experience on PBS did an incredible documentary on the Chinese Exclusion Acts, placing them in political and historical context, part of which is US v. Wong Kim Ark. This is 1898! Here's a clip on the case. I heartily recommend viewing the film in its entirety.

LegalEagle did a video on this. Very informative. They're trying to classify this as an invasion to reclassify undocumented immigrants as enemy combatants to be able to get the military involved.
