Only with habeas corpus, which is a little different. But they are trying to deport a lot of US citizens because they are using faulty software. Get in touch with the American Immigration Lawyers Association, your reps and senators (state and federal) , governor, and AG.
False. Someone didn’t read the ruling. Habeas corpus means “bring the body here.” It refers to the people already detained in El Salvador. We are talking about an American Citizen who is still on US soil. SCOTUS clearly ruled that
due process be afforded.
That's why they're taking this avenue now. It's not deportation by the state, it's a "lawful" (notice the liberal use of quotes) order to leave the united states you would receive when your visa runs out. "We didn't put them on a plane to El Salvadore, they left."
That doesn't mean they won't. They're going to get around it by claiming (as they do here) that the person in question was on parole in the first place, and the US is exercising its option to revoke that parole.
(2 of 2) the court’s order. There’s no way he will allow anyone to tell him what to do. (malignant narcissism). And, by the way, he’s also not leaving willingly. He will either die in office or be forced to leave.
(1 of 2) Well said! . We can’t give in to 47. We aren’t used to autocrats. We are used to people who act in good faith. We go to court. Even when we lose, we obey a court order, right? I grew up near where Trump did so i know what he will do. He will most CERTAINLY defy the court’s
Unless they put on hoods, grab you off the street, throw you in a van, drive you across the country, ship you to a prison/slave facility before your family can even call a lawyer. I feel that’s a bad movie plot but I’m pretty sure we’ve witnessed that on the news recently.
I have a feeling the administration will continue doing what they're doing and when they are called on it they'll say...yeah we had our own internal process. When they are asked what the process was, they'll say ... your ruling never said we had to document the process, but we sure had one.
I think you might have misread my posting. I was talking about what they could do in the future (which I don't agree with) not what they did in the past. Wishing you a good day and goodness seriously
I think a lot of us are searching for ways to resist/fight beyond what we’re already doing : boycotts, calling/emailing reps, protesting (im ready for nation-wide Hands-off! #2), ….
A certain amount of whining is therapeutic.😏
I believe they would reply, "You and what army?" Because they control that now. They have sacrificed the rule of law for the rule of might, and we are all going to relearn why we have the social contract.
People in badges and uniforms will have to follow a proper, legal order to take Mr. X or Y or Z into custody for contempt. That's when the shit will hit the fan.
We aren’t there… yet. Unfortunately there is a ton of misinformation and disinformation. At some point they will cross a line and people will rise up. When the regime openly refuses to obey court orders that’s crossing a very obvious line.
You implied that a legal challenge is fruitless. The mob is panicking. They have no alternative plan, mind you. This is exactly how autocrats seize power.
But even the Christian Nationalist majority voted him down this time. The oligarchs of the Heritage Foundation (Leonard Leo) and the petrochemical giants (Koch, Inc) are starting to peel away from him.
don’t want to poop on your parade, but due process is not a guarantee of a court hearing. Due process literally means getting to present your argument to … something judicial-ish: notice, an opportunity to be heard, &a neutral hearing body. We may have miles to go on how much process is due/fair.
If we are talking J.G.G. v. Trump, I can see that the court’s language (notice of removal, time for habeas petition, use of “judicial review”) may sound specific, but the repetition by the Court of “appropriate to the case” preceding those details =wiggle room (+ it being per curiam) as I mentioned.

What’s happening here is hardly unique. Read Ruth Ben-Ghiat’s Strongmen.
Let her answer my question. I asked for a reason.
Making that claim puts the burden of proof on the accused, not the accuser ... if we let them get away with it.
So,…

Panicking doesn’t help.
You gave up on the law. I still believe in it. People gave up
their moral authority in the Weimar Republic. You know what they ended up with.
I’m going to clarify for other people reading this: I am saying “don’t rest, still lots to do to protect due process.”
Also, your ableism is showing. You read my profile - I have a #chronicillness & cannot practice law anymore.
