This is literally always true of any regulation. Companies always have to decide, internally, whether and how to comply with the law. So if that what an internal limitation means, there aren't any external limitations.

That reasoning would make all performance-based regulation illegal. Industry very much wants performance-based regulation, which leaves the regulated industry free to chose the best way to comply with a rule given current technology. This is bad.
