to be 100% clear, as far as I know/have read, even if you got Got by the policy since January, you should still be able to apply perfectly fine because you're updating the info on it. obviously you'd have to pay for it again, which is expressly criminal, but it should work out fine at least

also if you have immediate international travel, and/or the resources to book something to provide a flimsy (but functional!) excuse for having immediate international travel, you CAN get emergency passport appointments in-person and get them printed there, that day

i have also remembered that the typical policy is "if there's an error you can get it fixed for free for up to a year after issuance" but that's a bit more "ok, we have to see how and if this order is implemented before commenting further"

It's possible that the DS-5504 would apply here, which would only stick you with postage. Hopefully we can get some guidance on that soon.

Be cautious here and talk to an attorney. You don’t want a stay to go into effect while they have physical possession of your documents.

the danger I see is seizure or destruction of documents as “fraudulent”. And I’m not saying not to, I’m just saying figure out what the risks are for you specifically and how they’d affect you before poking the bear—i.e. don’t assume this order is going to be in effect for the foreseeable future

I mean, maybe. They could also ramp up harassment without going that far. And if you were going to apply regardless of the order, this would be a good time. But if you’ve been willing/able to hold off but now thinking of doing it only because of this order, give it a week imo

I mean they still were returning our documents when it switched the first time - they just sent notes explaining they were printing an M on new passports. I don’t think we’re at risk of them seizing our papers.
