I really disagree with this reading. I don't disagree with the conclusion that we can't rely on the Roberts court, but the idea that this is some "wink wink" we'll take care of it for you, sent as a needlessly public communique, strikes me as very very very unlikely, if not more verys.

So if your point is that "we need to operate as though the Court isn't coming to help," that's totally right. But if the point is "this is actually Roberts secretly saying that the Court is in the tank for the stupid AEA arguments," then I don't agree.

People who make this argument say that if this was meant as a message of support to lower court judges, there are more private ways to communicate that. But if this was meant to convey support for the Admin positions, there are more private ways to communicate THAT!

That's fair. My point was to the general proposition on which we seem to agree. I don't know if Steve was saying this was a "wink wink" message to the judges or about this specific to this case. If so, it wasn't the best vehicle for my QP. 1/x

What I do think: This was much less a defense of lower court judges than it was an effort to preserve his power and forestall escalating attacks on himself and his SCOTUS colleagues when they DO (as you I think rightly predict here) eventually strike down elements of Trump's agenda. 2/x

But I do think there's a big "wink wink" element at play, much the same as the one he sent in his year-end report. Roberts knows he's got a lit powder keg on his hands (one he was happy to light, let's not forget, lest, god forbid, Democrats retain power). 3/x

They are going to fix it for him. Which is wrong on the merits. So here we go again expanding Executive reach until SCOTUS calls him a King.
