This. Folks are right to demand Trump's compliance with court orders, but you'd think we'd have learned our lesson by now that we can't trust the Roberts Court to be a guardrail for democracy. We *must* not walk into this trap. Popular resistance and power building are the only way out.

Project 2025 called explicitly for defiance of court orders where (as here) the administration unilaterally determines courts lack jurisdiction. Of course this wildly dangerous legal theory shouldn’t hold up. But what then?

If, as the Trump admin contends, the federal courts lack jurisdiction over a federal government flight over international waters, then there is nothing stopping the Trump admin from deporting American citizens. As soon as they reach international waters it is fait accompli.

You wanted post-liberalism, here’s the reality of it. Not an enlightened philosopher king pursuing your idealized notion of the common good, but the arbitrary and chaotic whims of a system tearing itself apart because it is not constrained by codified rules or any obligation of rationality.

These people are so hopped up on a reject theory that'll provoke a POTUS v. SCOTUS constitutional crisis that they'd forfeit Congress's power of the purse rather than just pass a budget that sets spending ceilings for Trump and then approve his rescission requests for mandatory spending items.

The institutional Democratic Party is guided by an almost pathological level of conflict avoidance in almost every direction. “What can we do to make the least number of people mad?” is just a bankrupt way to operate.

We're currently in a kind of constitutional purgatory: it's not clear the current constitutional order still holds. It feels a little bit like the US is Wily Coyote hanging out over the cliff and it's just a matter of time until we look down.
