The same way the judge in the anti-trans executive order case used science to dismantle claims about biological sex, journalists and others should use science (including social science) and history to dismantle claims that civil rights efforts are discriminating based on immutable traits.

It was to spread the search for talent as widely as possible to find all the good people. From hiring on, every employee has to pass training, testing, etc. for retention, advancement, promotion. See a Black professional? He or she has passed the tests. "Hidden Figures" showed that well. Talent.
