A law that constrains Trump but allows police to abuse citizens and kill with impunity... a law that constrains Trump but allows genocide... a law that sometimes constrains Trump but also creates opportunities w/rulings like Trump v. United States... is this a law worth defending?
I do not. He is the one that was accepting lavish trips before Thomas. He also used to get his conservative colleagues to refuse SCOTUS cases he believed the Conservatives would lose (pre polling of SCOTUS, biased selection. So unethical)
I was thinking mainly in terms of him not finding Constitutional support for Presidential absolute immunity and complete obsequiousness to Trump. He definitely agreed that SCOTUS Justices were entitled to certain "privileges."
I’m thinking he was a power grabber & follower. The way he helped the Right wing by getting scotus to not take cases Cons couldn’t win- He would’ve taken the opportunity to interpret constitution to support the absolute immunity & fealty to Trump.
Gee, I wish I had this optimistic faith in our judicial system. Maybe not being “in” it helps me see it for what it truly is so I’m not plagued with naive hope.
The law will matter for some people, those that are not wealthy & those that are Black & Brown. It will become more stark the difference. It will not matter for Trump or his people.
We need to seriously examine how the law has allowed for the grotesque amassing of political power in so few people. Yes, other things play a part, but the way things are these days, I keep wondering how they were able to get to where they are, often by using legal tools to their advantage.
There is a fatal flaw in your argument. You aren't thinking like a fascist. Fascists only care about the law when it benefits them. If the law gets in the way of what they want to do, they will ignore it. In the end, they will have the guns. If the law is to much in their way, they start shooting.
Mussolini himself was deposed by the Italian king and the Grand Council of Fascism after a vote. He would have *liked* to just ignore them, but he wasn’t able to. Only foreign military intervention put him back in power (and only as a figurehead).
I'm not sure what you're arguing for. Can you elaborate? I'm assuming you aren't arguing that we should install a monarch to stop the Trump administration. :)
I'm sure they will start with just having the FBI arrest anyone and everyone who they don't like. If we end up in the martial law scenario, it's just a question of whether the military is more loyal to Trump or the Constitution.
Just the opposite. They need to be fought against every step of the way with every tool available. Capitulation will just embolden them. What I want to get across is what's at stake.
We can't just hope what remains of our institutions will save us. They have clearly and repeatedly said that they want to weaponize the FBI to target their enemies and that they want to use the military for deportations and suppressing protests inside the US.
