And even though the circumstances are quite clear and the blame is implied there is still that way of writing that removes agency from the driver. It's such an ingrained habit.

That’s a really good point. Like the driver was behaving appropriately and it somehow went wrong for them and her.

Thinking a bit more, I think it is the lazy stock phrases. Why is the headline "hit by car" instead of "driven into"?

As the headline writer plying their trade, I would have thought "driven into" is more dramatic and actually more accurately encapsulates the event.
