Lot of folks learning for the first time that criminal & immigration civil systems are interrelated but separate. This means:
- criminal contact like arrest can trigger deportation *even w/o* conviction
- deportability requires no criminal contact at all
- immigrants not provided lawyer in imm court

This man was stopped in a routine traffic stop and did not have a license (which many non-residents do not). The cops photographed his tattoos, took him to jail, and then ICE put him on an airplane without telling his wife anything (no lawyer, not allowed to call her etc).

Yes, people can be put into deportation proceedings without being convicted or charged with a crime. And, no, legal representation is not a right.

There's not like one rule. It depends on a person's immigration status. So, for example, you can overstay your visa, which makes you deportable at any time for any reason. There are multiple reasons a person might be deportable.

Most of the people Biden deported during his presidency were "expedited removal," which does not require a court hearing and applied to individuals who are deemed deportable and have arrived within 14 days. Most other deportation proceedings have a judge although people can "self-deport" any time.

The judge is an immigration judge, not Article 3, and there's no right to counsel. It's not like a criminal trial. It's an administrative proceeding. The person facing deportation must prove they have a good reason to stay.
