I was the Biden presidential appointee at DOT under Secretary Pete. I was DOT’s chief people officer. I’ve read more OPM memos than I can remember. You’re spot on. OPM wants political appointees to decide the salaries of other appointees not career HR officials. Pretty remarkable if you ask me.

Does this memo remove salary caps altogether or just -- still bad! -- let them set a Sched C hire at the top of the scale w/o respect to classification, experience, etc?

Also, I think an earlier OPM memo greatly reduced restrictions on # of C hires and using C hires in GS billets

I don’t read the memo as removing the salary cap principally for non career SES. That’s dictated by a different set of regs. I read the memo as saying the agency head could make any potential salary determination, ie grade level for a Schedule C.

What this means: Let’s say an agency is hiring a “press assistant” typically a junior level role. The HR folks may say the potential appointee is qualified for a GS-9 salary (approx $69K). This memo suggests the agency head could decide to make the press assistant a GS-11 ($84K).

The reason you want career HR making salary decisions is to ensure the potential appointee is qualified for the job & salary level. You want to avoid some junior-level campaign field staffer from suddenly becoming a “senior advisor” to some under secretary making 150K a year.
