Bc of a compromise that was reached in negotiating the 1990 bill. The goal was to help migrants living in the US who had fled their countries because of unsafe conditions, caused in part by US intervention in those countries. Especially El Salvador in 1990
Additionally, the granting of TPS is at the whim of the federal government -- they determine who is eligible for TPS through a subjective process
A 2021 Supreme Court case said that no one with TPS was able to apply for more permanent legal status. So this has been a strategy building over years.
