I looked into it a little, and in most states, provided the deduction doesn’t take the server below federal minimum wage (including tips), it’s sadly legal.

See people make jokes about how awesome it is that waffle House can reopen so quickly in the lake of devastating natural disasters, whereas from my perspective it’s a sign that the company doesn’t really care about the long-term safety of its employees. So that is not surprising to me.
