Kozinski does not cite any comparable U.S. federal or state laws, and I am not aware of any. Instead, he points to the inapposite efforts to remove Trump from ballots that, correctly, relied on section 3 of the Fourteenth Amendment to our constitution.
A more minor point is that Kozinski elides the fact that, unlike many other countries including Romania, elections in the United States are decentralized.
The stories I heard about this man first hand from people who clerked for him are absolutely insane. More insane imo than some of the stuff that became public and led to him resigning.
It was an underplayed story even within the legal community. Everyone should understand that he was one of the biggest “feeders” to the Supreme Court, and then read the allegations about him. Good window into some of the problems in our legal culture, particularly our reluctance to criticize judges.
If there's one thing about the culture I would change, it's that reluctance to criticize judges before whom you do or may practice. At least in my state, the rightward lurch of the courts presents an opening for change.
