(Also, I was listening to Wyle's interview with Marc Maron, and it was going fantastic until without warning Wyle started discussing exactly what had happened 4 years ago to Dr. Robbie and I could not turn it off fast enough. Argh.)
I interviewed him and the producers for something running next week, and he did the same. I think he just loses track of what info has already been given out on the show and what hasn't. It will not be appearing in the final edit of my story, at least.
I love it. And I’m not a lawyer, but I don’t think “overextended emergency room doctors” is such a specific idea that the Crichton estate automatically has a right to this, regardless of what conversations were had.
Based on what I read, the themes and tone were unique from the get-go, but Wells and Wiley did initially consider The Pitt being set in the "ER world" focusing on John Carter years later.
They made changes AFTER failing to make a deal with the estate, not before.

I just started ER after watching The Pitt and I’m really enjoying it. I’m surprised by how well it holds up. As big fan of your books, are there any ER related books you would recommend?
Prestige TV producers can retire their 10 hour movies, because John Wells and his brand of procedural medical drama is a 1990s staple that remains must-see-TV.

I haven’t watched it because I’m really uncomfortable about their issues with the Crichton estate…
