Republicans love to push everything to the fringe
To make something obvious, lawful or even common sense to be seen as radical, over the top
They like to tire people out
They want to do it here: drain the energy to defend the thousand others who will come behind this case
Assholes rule this country
"This case concerns the government’s targeted, retaliatory detention and attempted removal of a student protestor because of his constitutionally protected speech."
"Indeed, contemporaneous and subsequent statements by administration officials expressly characterize the invocation of this rarely used provision as punishment for Mr. Khalil's lawful and protected speech."
***Interesting new info on venue: Khalil's attorneys say he was brought back to NY post-NJ!
"Moreover, the New York Field Office then brought Mr. Khalil back across state lines to New York before then transferring him, after the filing of the instant petition, to Louisiana."
Khalil's lawyers allude to Trump calling Chuck Schumer "a proud member of Hamas" and "a Palestinian" to illustrate the unseriousness of the characterization of Khalil as pro-Hamas
A strong passage in support of the argument that the attempt to deport Khalil is the fulfillment of broad Trump campaign rhetoric against protestors rather than any true foreign-policy issue
"The order's broad framing of 'hostile attitudes' towards the American government could encompass any form of political dissent, including Palestinian rights advocacy."
I thought this might come up w/r/t the declaration about moving him to NJ. It was super specific as to his movements throughout the night, and then all of a sudden vaguely referenced bringing him to "the airport" without specifying which airport or how.
It's almost too bad Khalil isn't a violent criminal - then he could count on getting a presidential pardon! Violent crimes are fine but peaceful protest is not. What is the world coming to?!
@gelbach.bsky.social To add to our discussion from yesterday, I think the fact that they moved him back to NY for transfer to LA while the habeas petition was filed might be enough here for the Judge to retain JX. It’s the best argument imo
Haven’t had time to read. One way or another I hope it stays in New York. But I will say that any rule that looks like what you’re describing strikes me as simply indefensible.
