Both branches are so afraid of Trump they are either ceding their powers to the Executive or giving the imprimatur of legitimacy to avoid a confrontation.

This is the single greatest argument that our Constitution is fatally flawed and no longer functional.

But because Trump is Trump, he will not be content with the current (apparently tolerable) level of lawlessness. He will keep reaching for more, until a) the Court must stop him or b) it is too late to stop him.

Can we narrow it down to Roberts? In his role as head of the Judicial Conference, it is his responsibility to provide the institutional support the federal judiciary needs. So far he has issued a brief 31-word statement (only verbally, not even on paper).

And SCOTUS' opinion on the deportation case this week hung Boasberg out to dry—not a good sign.

This is a John Roberts failure that we could be discussing more.

Roberts is surely aware that he leads, what Hamilton called in Federalist 78, the "least dangerous" branch.

They won't engage with the lawlessness because they know that when they do, when they decisively tell Trump no, he will tell them to go F themselves.

And then SCOTUS' power is over.

Trump is illegitimate and he needs to be removed; it needs to be challenged because Colorado courts' finding that he committed insurrection wasn't even addressed by the corrupted right wing SCOTUS when they perverted the Constitution to give him limited immunity! Illegitimate!
