Fair enough. But as the DHS head, there should be a minimum level of competence that she needs to meet, using objective criteria (like getting the definition of habeas corpus correct). The whole administration is "bad at their jobs" when it comes to what the jobs *should* be.

It is currently presupposed that the Senate will do its job and not consent to cabinet-level picks who are unqualified for the office. That's what makes the passage of that kind of law so unlikely. It is impossible to believe that Congress will voluntarily choose to restrain itself in this way.
