What do you mean end up?! There is already a 45% tariff between the 301 and the IEEPA tariffs. If you include Section 232, you are at 70% that is if you know the country of smelt and pour, otherwise it’s 245%. That if there are no standard tariffs to begin with.

The capacity to enforce most tariffs are there (and they’re collecting more already) but for some stuff they clearly don’t have it. We’re almost two months from when they banned-then-unbanned De Minimis shipments from China with a promise to re-ban it later but they’ve never followed up on that.

The oil is still shipped by tanker from an origin port and purchased from a production company. OPEC sets a basket of prices the members of the cartel agree to. The oil is not somehow all shipped to a central location, mixed, and redistributed.

The order delegates all of those decisions to the Secretary of State, so as far as I can tell Rubio could simply do nothing, but he seems pretty committed to miserable self-abasement so who knows. Also, once the tariff is on, he can leave it on till *one year after they stop* importing VE oil.
