O Conner recused himself in Musk's crazy lawsuit against the World Federation of Advertisers back in August. It's one thing to take cases that allow you to push an agenda quite another to becomes Musk's hatchet man/bitch boy for bullshit.

O'Connor owns stocks in one of the companies being sued in the advertisers case. But he did not recuse himself in the bogus lawsuit against Media Matters.

O'Connor is absolutely happy to be Musk's hatchet man as long as it doesn't get him in trouble.

I love the idea of this judge suddenly having to cover every single lawsuit related to an international multi-billion dollar company, in addition to their already existing caseload. Sometimes blatant corruption paying off doesn't pay off the way you'd like.

The SCOTUS judge who oversees the 5th circuit is Alito. I'm gonna hazard a guess that the enforcement of any ethics standards is... selective.

Yes, it's perfectly legal--as is language in Threads' TOS that disputes be heard in the Northern District of CA--and there's really not a serious argument that there's a conflict of interest simply because O'Connor is one (of numerous) judges in the Northern District of TX.

The conflict argument is worthless, but is a venue or forum selection clause enforceable when it has no relation to the parties or the dispute (other than the clause)? Under Ohio law the answer is almost certainly no. But I don't know about others.

Hard to imagine that most disputes between me (in SD Ohio) and Twitter (in WD Texas) could be properly venued in ND Texas under §1391. No idea about what Texas law would say about Tarrant County as a venue.

The specification of Tarrant County means the case would be specifically in the Fort Worth division of the Northern District of Texas, in which Reed O'Connor is effectively not one of numerous judges but one of only 2.2 judges (he gets 45% of the cases).
