Okay, so I have seen a few places that OPM may have quietly taken out the language about it being voluntary to respond to the OPM due to privacy act. So I don't know if it would be okay to not respond based on the privacy act anymore. And I am so sorry that you are being treated this way.

I have yet to receive any instructions on the prior message or the one I got on Friday night. The closest thing we got as guidance at VA was that it was a valid email and we *could* respond. Nobody in my chain of command told me I should or must respond.

Don't know. I feel like I can still do the work. None of my oversight and compliance duties have been compromised. I'm still allowed to build and distribute report materials and conduct chart reviews. So my option, right now, is to put up with the BS so I can serve the Veterans.

If dept leadership instructs workers to answer the email, does that moot any legal challenges that OPM as such lacks the authority to demand responses on pain of dismissal?
One might argue that the point of the challenges was to smoke out the original source of the mandated cuts. Arbitrary and capricious cuts will continue to be challenged no ? Appointments Clause and Administrative Procedures Act still in play.
I was just thinking of the authority of OPM to demand email replies from employees of Cabinet depts not under their direct authority. I think AFGE or somebody was challenging it?
At least several of the agencies are instructing employees to send the responses through their normal chains of command rather than to OPM and are even setting up specific mailboxes to do so. Might be a way to go around those issues by making it an agency mandate instead of an OPM one.
The challenge is whether it violates something like DOD’s harassment policy, which exempts things done for a lawful purpose, but probably doesn’t protect something like SECDEF saying to reply to DOD’s email in order to comply with OPM’s “requirement” given court’s finding. Matter for agency IG.
The “ask” his marauders are making can do little except disabuse them of the notion that there many “ ghost” employees who collect pay but do not work or do not exist and in their fever dreams are getting a paycheck. Foolish little ankle bites to most but exercise in power to some.
