I did not clerk for Wormuth, but I clerked in the same courthouse and was on good terms with his clerks at the time. I will say that this MJ is not very ideologically driven - and even if he were, we'd be less likely to see THIS outcome. I'm sure he reached this conclusion carefully & thoughtfully.

If the case only turns on mens rea, surely at some point "the entire US border is now an army base" must be considered common knowledge, no?

It's frankly offensive that we even have to pretend that the army base declaration is a real thing; IMO the court should have been asked to reject that.

I think most of these men and women know they are making history and fighting fascism. They also know that anything they do will be appealed endlessly. I’ll bet my boat there will be a written opinion.
