So the belief in the justness of the death penalty is not valid as a way of organising society because it cannot be done justly. But the belief itself is not proved to be false, only impossible to put into practice given the desired framework.

Yes, but that is a contingent conclusion. It is false within those parameters & therefore invalid. Tweak the parameters, & you might have a different conclusion. This is why the overall idea about the death penalty cannot be reduced to true or false the same way the flat earth issue can.
Exactly! It all depends on what we prioritize as our shared goals. For the people that prioritize literalness, being close minded is valid and your open mindedness is not.
True, but we need to establish the framework for assessing whether something is valid or not - but then in the sense that it is logically or morally coherent & consistent, not whether it can be empirically proven.
