Guarantee he just saw this in a movie or tv show, a character taking the identity of someone who just died and taking their benefits is a trope I've seen more than once, and is 1000x more difficult in the real world since the relevant agencies use shared databases nowadays.
If you don’t declare the death, that’s a crime. Living with a dead guy means you get the checks, but eventually you’ll be found out. Then you have to pay back social security.
If you want to keep getting someone's social security payments after they die you need to dispose of the body and carry on various ruses to make others think they're still alive. Most people aren't up to all that.
And when they catch up to you, and they will, you will be prosecuted.
“The penalty upon conviction for violation of the penal provisions of the Social Security Act, or one of the related provisions of the Federal Criminal Code may be a fine, imprisonment, or both.”
“The penalty ranges from a fine of not more than $500, imprisonment of one year, or both, to a fine of not more than $10,000, imprisonment of not more than 15 years, or both. The penalty depends upon the specific law violated.”
Not only that but when I submitted my mom's last (posthumous) tax return I checked the box on the 1040 that she had passed away. So BOTH Social Security and the IRS knew.
I didn't know he was saying this. Having lost my parents, husband, and brother I was well aware they take care of this. Not only does it prevent fraud, it's great to have one less thing one must do when a loved one dies.
Truth! My funeral home notified me of this when I inquired how long it would take to get death certificates I would need to send to SS and others, after my husbands death last July.
Also can confirm. Mom died in late Dec. 2024. SS direct deposited January payment and undirect deposited it 5 days later once notified. Super easy. Elon is a cunt.
Not only do they take them out of the system, they claw back the last payment. My dad died in the afternoon of the 31rst of the month and they still took back the payment for that month.
Can confirm. My dad died on Feb 5th 2018 at around 2AM. They rescinded his payment that month when my mom was scrambling to find the money to cover funeral costs.
They also freeze their bank accounts. Did your mom have to go down to the bank with the death certificate to get the account reopened? Lot goes on most people don't know about.
Yes. AND because my dad was on one of my checking accounts, Wells Fargo froze my account too. I live in LA and he was living in FL when he died. I was also in the process of closing on my house, which added more chaos. Luckily I was in Florida when this all happened so we were able to resolve it.
That's what I meant. SS just took the money back. You need a death cert to unfreeze the accounts, that can take a week. In the meantime your mom was in a pinch.
SS pays in arrears, so the payment received in Feb was for January. If SS took that payment back due to a death in Feb then you should file a claim to get it back because taking it in the month of Feb was incorrect.
Not sure when they took the $. He died on the 5th. The wake was on the 14th (the same day as the Parkland shooting) and he was buried a few days later. I remember I was in FL for a lot of Feb. it was between the 6th (my birthday) and the 20th (when I closed on my house) the bank froze the accounts.
I find it very interesting that the godless, soulless, subhuman republican creatures don't realize that they only have one earth to live on.
Do they not understand that people will find them? That people will bring justice to them?
They stopped town halls and hide in Washington. They have homes.
It's only the dead people whose relatives have their body on ice; the relatives cash the check, not the unreported dead person.
PS: it's a crime to collect a dead person's SSI🙄

Hahaha
They're draining the Treasury.

But I will also stake my life on it being small enough that it's not actually worth the cost of a deep, forensic audit.
If it was they would do those audits regularly.
The cost of hiring us is not justified by the tiny amount of fraud we find. The visibility and analysis is what we sell on.
