There's really no need. Birth right is in the Constitution.

The issue is that birth right has no definition, and we've operated from an agreed upon consensus until now. And whether they try to forcibly define it or forcibly adjust that consensus it is still leaving room for manipulation.

Seems like a definition to me. Not sure what reasonable court would have a hard time interpreting *all* persons *born in* ...
But then again ... can no longer count on reasonable courts.
