Also, responsibility is fully on the Army helo pilot. ATC is not in the cockpit to help you fly. Once you tell them you have traffic in sight and intend to maintain visual separation, that’s a promise. Not catching a pilot error is contributory. Pilot error was causal, and that was a very bad error.
