Meanwhile, last night, the NDTexas judge ruled. He denied relief because (1) he wanted to give govt 24 hrs to respond; (2) it was Good Friday; (3) ACLU had already appealed an earlier TRO denial, allegedly divesting him of jurisdiction.

I may not always agree, but I think SCOTUS/the courts are adeptly playing the long term legitimacy game, necessarily balancing numerous political and legal interests. They are posturing to continue defending the rule of law (checking the Administration) in the most politically credible way possible.
