Tomorrow, at noon, Judge Farbiarz (DNJ) will hold a hearing on whether to release Mahmoud Khalil on bail. Khalil, in custody in Louisiana, requested the hearing 91 days ago. Since then at least 5 others similarly situated have all been released. Thread. 1/21

"Punishing Petitioner for protected speech or using him as an example to intimidate other students into self-deportation is abusive and does not reflect legitimate immigration detention purposes." Habeas granted for Minn. State protester Mohammed H. /1 s3.documentcloud.org/documents/25...

Coming up at 10:30am in Harvard v. DHS, the latest skirmish in Harvard's conflict with the federal government: a preliminary injunction hearing over refusing to issue student visas to international Harvard students (this is the 2nd TRO in this case; the TRO was granted on June 5.)

Watch this week’s Trials of the Trump Administration where @benjaminwittes.lawfaremedia.org, @annabower.bsky.social, @qjurecic.bsky.social, James Pearce and @rparloff.bsky.social discussed the legality of Trump federalizing the CA National Guard, updates in Alien Enemies Act litigation, and more.

In 1 hour, watch @benjaminwittes.lawfaremedia.org, @annabower.bsky.social, @rparloff.bsky.social, James Pearce and @qjurecic.bsky.social discuss yesterday's hearing on President Trump's federalization of the CA National Guard, the pretrial detention hearing of Kilmar Abrego Garcia, and more.

Judge Farbiarz DECLINES to order release of Mahmoud Kahlil. Says he'll have to try to ask an immigration judge to grant him bail.

Govt says it's not releasing Mahmoud Khalil. Judge Farbiarz only barred govt from detaining Khalil based on Rubio's "foreign policy" determination. While judge said it was "unlikely" govt would try to detain him based on claim of inaccuracy on his LPR application, he didn't bar it.

NEW: Mahmoud Khalil submits a letter to Judge Farbiarz asking the court to order his release. The letter says he has posted bond, and the government has not filed a notice of appeal for the court's preliminary injunction (which went into effect at 9:30am this morning).

The en banc Second Circuit has denied review of a panel's earlier affirmance of the first E Jean Carroll verdict against Trump: $5m for sex abuse & defamation. 2 judges dissent, but I haven't gotten that yet. Here's a concurrence. ($83.3m verdict still on appeal.)

And ~12 minutes later, Trump appeals to US Court of Appeals for Ninth Circuit.

Seems that govt may be consenting to Kseniia Petrova's release with conditions. (This relates to criminal charges for bringing in undeclared frog embryos.)

Tomorrow, June 13, Kilmar Abrego Garcia will appear in court for an arraignment and—potentially—a pretrial detention hearing. In @lawfaremedia.org, James Pearce writes about what to watch for during Abrego Garcia’s Hearing: www.lawfaremedia.org/article/what...
