It would be a damn shame if the DC and Virginia Bars, where Brett Shumate is licensed, found out that he was making bad-faith unconstitutional arguments.

That's spurious and only serves to further piss off the judge. When a judge asks for your opinion in an argument of course they only expect you to give your clients position not your own personal opinion about it. If you don't want to say it's your opinion just say "our position is..."
What he is doing is boiler plate fascism. The current DOJ do not see the constitution as the foundation for US law but as a barrier to be dismantled and broken. If he cared or believed in it, he wouldn’t have been hired for this position.
