Does appear the the service they're using for AI image IDing, Hive AI, has that TOS. There's a possibility Bluesky is paying for a carve-out that's not been disclosed, but even if they are, it's a reminder that anyone could hook up the atProtocol firehose to an s3 bucket to build a training set.

Sure, anyone can connect the Firehose to a scrapper but as an artist I don't agree when my data is processed. but what is transmitted to hive we can't control and there we agree under the pretext that they say "it's for content moderation". We don't know anything about special deals that protect us.
