Well I don't follow you for your con law takes.
Something is illegal if it's a violation of law or otherwise lacks legal basis or authority.
Implicit in your suggestion is that only courts can decide violations. That's a really crimped understanding of the constitution in my view.

Ok. I think that in the English sense, it is perfectly possible for a government action to be legal but unconstitutional.
